JUSTICE SANDEEP KUMAR ORAL ORDER 19-07-2023 1.This application has been filed for modification of the order dated 15.05.2023 passed in Cr. Misc. No. 24053 of 2023 by which the petitioner has been granted bail. 2.It has been pointed out by the learned counsel for the petitioner that in the order dated 15.05.2023 passed in Cr. Misc. No. 22419 of 2023 in paragraph No. 4, due to inadvertence the custody of the petitioner has been typed as "24.01.2022" in place of "16.03.2023" and the petitioner has "two antecedents" but due to inadvertence it has typed as "seven criminal antecedent".

3.Let the same be corrected and be read as "The petitioner is in custody since 16.03.2023" and "Petitioner has two antecedents."

No.44448 of 2023(2) dt.19-07-2023 2/2 4.Learned counsel for the petitioner has submitted that the petitioner has been granted bail and was directed to be released on bail after framing of charge but due to nonavailability of the Presiding Officer of the Court, the charges have not been framed and the framing of charge will further be delayed because of the large number of the accused person in this case.

5.He further submits that the petitioner will appear regularly in the Court below through his lawyers or himself and in case of any default, appropriate order may be passed. 6.In view of the above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Excise Judge, Court No. 1, Purnea/concerned Court below in connection with Jalalgarh P.S. Case No. 14 of 2022. 7.This modification application is allowed to the above extent .
