JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 23-03-2017 Heard learned counsel for the petitioner and learned counsel representing the State.

The petitioner seeks bail in connection with Kuchaikot P.S. Case No. 14 of 2017 registered for the offence punishable under Sections 414/34 of the Indian Penal Code. Allegedly, Deepak Pandey @ Ghonchu Pandey and Baidik Pandey @ Sanjit Kumar Pandey were caught with stolen motorcycle by the owner of the motorcycle and before Police both apprehended persons disclosed that this motorcycle was stolen by Tiger Singh @ Sunny Singh from the door of Parma Singh and after changing the number he has given to them. Submission is of false implication and that the petitioner was not apprehended at the spot, nothing has been recovered from conscious possession of the petitioner and only on the basis of statement of co-accused the petitioner has been implicated,

Patna High Court Cr.Misc. No.10660 of 2017 (2) dt.23-03-2017 resulting, he is suffering in custody since 13.01.2017. Learned APP fairly submits that the name of the petitioner was taken by two co-accused who were caught by the informant. In the facts and circumstances stated above, the petitioner above named is directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gopalganj in connection with Kuchaikot P.S. Case No. 14 of 2017, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
