JUSTICE RAJAN GUPTA) 30-11-2021 Grievance of the petitioner is that his appeal, pending before the District Magistrate, Patna, has been dismissed for default.

On due consideration of the matter, we feel that the issue requires to be heard on merits, we, therefore, set aside the impugned order dated 30.06.2015 passed by the Sub-Divisional Officer, Barh and remit the matter back to the same authority for decision on merits as per law. The Authority shall decide the same within the statutory period provided under the provisions of the Bihar Targeted PDS (Control) Order, 2016.
