The petitioner seeks bail in Muffasil P.S. Case No. 212 of 2017 registered under Section 304-B/34 of the Indian Penal Code.

Petitioner along with other family members are said to have committed dowry death of the sister of the informant over not coughing up the motorcycle in dowry.

It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has been falsely implicated by the informant due to ulterior motive. He happens to be father-inlaw of the deceased. The allegation levelled against the petitioner is not specific rather general and omnibus in nature. He has been

Patna High Court Cr.Misc. No.19279 of 2018 (05) dt.18-05-2018 - 2 - living separately from the deceased and has no concern with the affairs of the deceased and her husband. Several witnesses during investigation have stated that the deceased has committed suicide over dispute with her husband. The petitioner has been languishing in custody since 11.01.2018.

In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Katihar in connection with Muffasil P.S. Case No.212 of 2017.
