NILU AGRAWAL ORAL ORDER 03-03-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.
Petitioner is languishing in judicial custody since 26.10.2016 in connection with Kharagpur P.S. Case No. 186 of 2016 registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
The prosecution case is that the police on a secret tipoff raided the house of the petitioner and found 61 bottles of foreign liquor each containing 750 ML, whereas from the house of the co-accused, who is stated to be the associate of the petitioner, 22 litres of foreign liquor was recovered.
It has been submitted by the learned counsel for the petitioner that he is innocent, has no criminal antecedent and that
Patna High Court Cr.Misc. No.6423 of 2017 (2) dt.03-03-2017 2/2 on similar allegation, his associate has since been granted the privilege of bail by a Coordinate Bench of this Court in Cr. Misc. No. 4113 of 2017 on 20.02.2017.
However, learned A.P.P. for the State opposes the prayer for bail.
Considering the facts and circumstances and that with similar allegation, co-accused has already been granted the privilege of bail, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-IV, Munger in connection with Kharagpur P.S.
