2. The petitioner has preferred this application for grant of regular bail in connection with Bihariganj P.S. Case No. 46 of 2025 dated 06.02.2025 registered for the offence/s punishable u/ss 115(2), 126(2), 303(2), 87, 137 (1), 352 read with section 3(5) of the BNS.

3. As per the prosecution case, the petitioner and the co-accused persons are alleged to have entered the house of the informant and looted Rs. two lakhs and they also kidnapped his minor daughter.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in

As per the statement of the victim recorded u/s 183 of the BNS, the victim was not forced or seduced to have illicit relationship with another person. There is no allegation of sexual assault against the petitioner. As per the medical report, the age of the victim is assessed as 18-20 years. Nothing has been recovered from the conscious possession of the petitioner. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 04.03.2025.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner and stated that the victim is a minor girl.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Udakishunganj, Madhepura in connection with Bihariganj P.S. Case No. 46 of 2025.

7. The application stands allowed.
