Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with K. Nagar P.S. Case No. 84 of 2021 lodged under Sections 8/21/22 (B)(C) of the N.D.P.S. Act.

As per the prosecution case, the recovery of N.D.P.S. material total 400 gm of brown sugar from the possession of the present petitioner has been done.

Learned counsel for the petitioner submits that the petitioner has clean antecedent and petitioner is in custody since 02.03.2021 and charge sheet has already been filed in this case. Learned counsel for the State opposes the prayer for

Patna High Court CR. MISC. No.49865 of 2021(4) dt.27-09-2022 2/2 bail and submits that F.S.L. report has been demanded in this case. The F.S.L. report is on record which confirms that the brown sugar substance is heroine. The report indicates that charge sheet has already been framed in this case and case is fit for prosecution witness.

In the present facts and circumstances of this case and the submissions made above, I am not inclined to grant bail to the petitioner.

With this observation, the bail application stands rejected.
