JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 3 19-08-2015 Heard learned counsel for the petitioners. Despite repeated calls, none appears on behalf of the State. The petitioners seek anticipatory bail in connection with Paliganj P.S. Case No. 337 of 2013 registered under Sections 341, 323, 379, 504 and 307 read with 34 of the Indian Penal Code.

It is contended that petitioner no. 1 happens to be uncle of the informant, whereas petitioner no. 2 is her cousin brother. The allegations made in the first information report are not true and there is no injury report to corroborate the prosecution case as made out in the first information report. It is

Patna High Court Cr.Misc. No.48346 of 2014 (3) dt.19-08-2015 2 / 2 further contended that genesis of occurrence is land dispute between the parties. The petitioners having no criminal antecedent have got roots in the society and are not likely to abscond or tamper with the evidence.

Regard being had to the facts and circumstances of the case, in the event of arrest or surrender in the court below within a period of four weeks from today, the petitioners are directed to be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., at Danapur, Patna in connection with Paliganj P.S. Case No. 337 of 2013 subject to the conditions as laid down under Section 438(2) Cr. P.C.
