The petitioners apprehend their arrest in Kateya P.S. Case No. 342 of 2018, registered for the offences punishable under Sections 341, 323, 324, 307, 435, 379, 504 and 34 of the Indian Penal Code.

It is submitted on behalf of petitioners that there is case and counter case. This case is counter blast of Kateya P.S. Case No. 336 of 2018 which has been lodged prior to this case. Moreover, this case has been lodged after delay of four days from the date of occurrence without any plausible explanation, only with a view to save their skin from the earlier

Patna High Court CR. MISC. No.37355 of 2019(3) dt.21-08-2019 2/2 case. Admittedly, there is land dispute between the parties and a title suit no. 700/12 is pending between them. Petitioners have got no criminal antecedent.

Considering the facts aforesaid, the petitioners abovenamed, in the event of their arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate XV, Gopalganj in connection with Kateya P.S. Case No. 342 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
