2. Petitioner seeks regular bail in connection with Hisua P. S. Case No. 727 of 2023 in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Amendment Act.
3. As per the prosecution case, 140 liters of country made illicit liquor were recovered from motorcycle of the petitioner.
4. Learned counsel for the petitioner submits that he is innocent and has committed no offence. He has been falsely implicated in this case only because he is the owner of the motorcycle in question. Petitioner has not been arrested on the spot and no incriminating material has been recovered from his
Patna High Court CR. MISC. No.40827 of 2025(2) dt.08-08-2025 2/2 conscious possession of the petitioner. He has given his motorcycle to a co-villager for purchasing medicine. Petitioner is in custody since 02.05.2025. Petitioner claims clean antecedent.
5. Learned A.P.P. for the State vehemently opposes the bail application.
6. Considering the aforesaid facts and circumstances of the case and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court-I, Nawada in connection with Hisua P. S. Case No. 727 of 2023.
