JUSTICE SUDHIR SINGH ORAL ORDER 16-09-2016 Heard learned counsel for the petitioner and the State. The petitioner is in custody in a case registered under Sections 419, 420, 467, 468, 471 and 120B of the Indian Penal Code.
It is alleged by the informant that he has four brothers, namely, Manoj Dewedi,Anand Abhishek @ Munna Dewedi and Vivik Devedi. He along with his brothers are living in Patna City with his mother. He has got ancestral land at village Mahamdpur of an area 80 decimals bearing Khata no. 293, Khesra No. 293, 791, 782 and 785. Amarendra Rai and Ravindra Kumar Rai produced a person in place of informant Santosh Kumar and got the sale deed registered in their favour.
It is submitted on behalf of the petitioner that the
Patna High Court Cr.Misc. No.32337 of 2016 (3) dt.16-09-2016 2/2 petitioner is in custody since 10.06.2016. Charge sheet has been submitted in this case. The petitioner has got no criminal antecedent. There is no allegation of tampering with the witnesses alleged against the petitioner. The petitioner is a professor in Lalit Narain Mithila University. The matter relates to civil dispute. Admittedly, there was an agreement for sale between the parties and a Title Suit is also pending between the parties. On behalf of the State and the informant it is submitted that by way of fraud the sale deed, in question, has been obtained by the petitioner.
Having considered the facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Samastipur in connection with Mohiuddin Nagar P.S.Case No. 159 of 2015,G.R.No. 2212 of 2015.
