Also seen an explanation submitted by the Superintendent of Police, Saharsa. Because of the fact that chargesheet had already been submitted, on account thereof, the same is accepted. Learned counsel for the petitioner submits that instant petition may be disposed of in terms of Annexure-3, an order dated 23.01.2013 passed by this Court in Cr. Misc. No.48170 of 2012. On the other hand, learned Additional Public Prosecutor did not object.

Considering the prayer made on behalf of petitioner, the prayer of the petitioner should also be disposed of in the same terms whereunder Criminal Miscellaneous No.48170 of 2012 (Annexure-3) had already been disposed of and is accordingly, held so. (Aditya Kumar Trivedi, J) Vikash/- U T
