The petitioners seek bail in Raxaul P.S. Case No. 265 of 2016 instituted for the offence under Sections 30(a) (d) of the Bihar Prohibition and Excise Act.
It is submitted that both these petitioners have clean antecedent.
As per allegation, total 32 litres of country-made liquor and liquor manufacturing apparatus was recovered from possession of petitioner no.2 and total 60 liters of county-made liquor and liquor manufacturing apparatus was recovered from possession of petitioner no.1.
Both these petitioners are said to be in custody since
Patna High Court Cr.Misc. No.12951 of 2017 (2) dt.22-03-2017 2/2 22.11.2016.
Keeping in view the clean antecedent and the period spent by the petitioners, the prayer for bail of the petitioners is allowed. Let the petitioners above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Subdivisional Judicial Magistrate, Raxual, Motihari, East Champaran, in connection with Raxaul P.S. Case No. 265 of 2016, subject to the condition that both the bailors will be the close relatives of the petitioners.
If the petitioners indulge in such type of activities in future, their bail will be liable to be cancelled by the court below. (Sanjay Priya, J) Ravi/- U T
