The petitioner is accused in connection with Madhuban P.S. Case No. 89 of 2005, registered under Sections 395, 397, 436, 353(A) of the Indian Penal Code, Section 27 of Arms Act, Section 3/4 of Explosive Substance Act and Section 17 of the C.L.A. Act.

Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. The petitioner was apprehended in Madhuban P.S. Case No. 87 of 2005 and Police got recorded confessional statement showing his involvement in the present case, except the confessional statement, there is no evidence to show his involvement in the present case. Further

Patna High Court Cr.Misc. No.27743 of 2016 (2) dt.12-07-2016 2/2 submission is that petitioner is accused in six other cases, but he is on bail. The petitioner is in custody since 11.12.2015. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M. Sikrahana at Dhaka, East Champaran in connection with Madhuban P.S. Case No. 89 of 2005. Out of two sureties, one surety must be the close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
