JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 18-04-2022 Heard learned counsel for the petitioner and the State. The petitioner seeks regular bail in registered for the offences punishable under sections 302/34 of the Indian Penal Code and section 27 of the Arms Act.

As per the prosecution case, this petitioner opened fire causing death of the son of the informant. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case due to previous enmity. No incriminating material has been recovered from the conscious possession of the petitioner. Petitioner has got clean antecedent as stated in paragraph 3 of the bail petition. Petitioner is in custody since 11.9.2020. Learned counsel for the State opposes the prayer for bail and submits that there is direct and specific allegation

Patna High Court CR. MISC. No.49299 of 2021(3) dt.18-04-2022 2/2 against the petitioner that he opened fire causing death of the son of the informant.

Considering the nature of accusation and materials available on the records against the petitioner, his prayer for bail is refused.
