The petitioner is in custody since 28.01.2018 in connection with Dehri Town P.S. Case No. 88 of 2018 for the offence registered under Sections 420, 467, 468, 471, 472, 120(B)/34 of the Indian Penal Code and Section 66(A) of the Information Technology Act.
The petitioner is a Computer Operator, who is alleged to have used the user ID of the informant's company for creating fake challans for release of sand from the State Department. Learned counsel for the petitioner submits that altogether false and frivolous allegation has been levelled against the petitioner, as no challans alleged to have been so prepared
Patna High Court Cr.Misc. No.20477 of 2018 (3) dt.04-05-2018 were used by the petitioner and if, at all, any such complaint was there, it was the duty of the State to verify the same and lodge the necessary complaint. It is further submitted that though allegation is that the State as well as complainant had been subjected to loss of revenue and business respectively yet there is nothing on record to show such loss.
Diary of the present case was called for which has since been received.
Learned counsel for the State, after perusal of the case diary, submits that save and except suspicion, there is no further material in the case diary.
Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of SubDivisional Judicial Magistrate, Dehri, Rohtas at Sasaram in connection with Dehri Town P.S.
