IN THE HIGH COURT OF JUDICATURE AT PATNA
Criminal Miscellaneous No.29758 of 2016 Arising Out of PS.Case No. -162 Year- 2015 Thana -KHAIRA District- JAMUI ====================================================== Ranjeet Mandal .... .... Petitioner/s
Versus
The State of Bihar .... .... Opposite Party/s ====================================================== Appearance :
For the Petitioner/s : Mr. Rajesh Kumar Sinha For the Opposite Party/s : Mr. Sri Ajay Kumar Jha ====================================================== CORAM: HONOURABLE JUSTICE SMT. ANJANA MISHRA ORAL ORDER 10-11-2016 Heard learned counsel for the petitioner, Informant and learned counsel for the State.
The petitioner is an accused in a case in connection with Khaira P.S. Case No. 162 of 2015 registered for the offences punishable under Sections 304(B), 201/34 of the Indian Penal Code.
Diary of the present case was called for, which has since been received.
After hearing learned counsel for the petitioner and learned counsel for the Informant, it appears that the petitioner and the informant have entered some sort of compromise, which is not permissible in law. The diary of the present case indicates that the victim lady was killed and then surreptitiously her body was cremated without knowledge of the informant, however, at present different colour has been given.
Patna High Court Cr.Misc. No.29758 of 2016 (4) dt.10-11-2016 In view of the nature of allegation levelled against the husband of the deceased lady, I am not inclined to grant regular bail to the petitioner. It is, accordingly, rejected. (Anjana Mishra, J) Jagdish/- U T
