JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-08-2019 This application, for grant of anticipatory bail, arises out of Kudhani P.S. Case No. 632 of 2018, disclosing offences under Sections 25(1-b)a, 26 and 35 of the Arms Act and Sections 399 and 402 of the Indian Penal Code. Prosecution case is that police on information that some miscreants have assembled for committing dacoity, raided the place and arrested some of the co-accused and from one of the co-accused one country made pistol has been recovered and the arrested persons disclosed the name of the petitioner as their associate.
Submission of learned counsel for the petitioner is that save and except the confessional statement of co-accused, there is absolutely nothing against the petitioner. Further submission is that he has no criminal antecedent and has falsely

Having heard both sides, considering the submission, as above, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -III, West Muzaffarpur, in connection with Kudhani P.S. Case No. 632 of 2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
