2. The petitioner apprehend his arrest in connection with Sheikhpura (Kusmbha) P.S. Case No. 106 of 2023 registered for the offences punishable under Sections 147, 148, 149, 323, 307 & 354 of the Indian Penal Code.
3. It is alleged that the all the FIR named persons armed with axe and sword assaulted the husband of the informant and misbehaved with female members of the informant.
4. It is submitted on behalf of the petitioner that the petitioner is an old man and he has been falsely implicated in this case by the informant due to old enmity. It is further

No.40704 of 2023(2) dt.01-08-2023 2/2 submitted that there is no specific allegation of assault against the petitioner and it is pertinent to state here that allegation of assault on vital part like head of the deceased is against other co-accused persons. Petitioner claims clean antecedent.
5. Considering the facts of the case, this pre-arrest bail petition is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount to the satisfaction of the learned Chief Judicial Magistrate, Sheikhpura in connection with Sheikhpura (Kusmbha) P.S. Case No. 106 of 2023, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
