The petitioner apprehends his arrest in a case registered under section 498A of the Indian Penal Code and 4 of the Dowry Prohibition Act.

According to the prosecution case the complainant Sama Praveen was married with Nasimuddin Ansari in 1998 according to Muslim rites and rituals. She blessed with two sons and a daughter with their wedlock but her husband and other accused persons started demanding Rs. 1 lakh, T.V. freeze and motorcycle and due to non-fulfillment they abused and assaulted her. Accused persons also locked her in a room and tried to set fire on her body but the complainant open the door and raised alarm. The neighbours came there and saved her. She was also ousted from her

It has been submitted on behalf of the petitioner that petitioner is ready to keep his wife with all respect and dignity but the same is not acceptable to her. It is further submitted that petitioner is ready to deposit Rs. 2000/- per month in the court below which shall be released in favour of the complainant.

On behalf of the State it is submitted that petitioner is named in the first information report.

Considering the aforesaid facts, the petitioner is directed to deposit Rs. 2000/- per month in the court below which shall be released in favour of the complainant and thereafter the above named petitioner in the event of his arrest or surrender in the court below within a period of four weeks from the date of receipt/production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of S.D.J.M, Patna in Complaint Case No. 240© of 2013, subject to the conditions as laid down under section 438(2) Cr.P.C.
