The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 30(a), 36 and 38 of the Bihar Prohibition and Excise Act. There is no recovery from the possession of the petitioner and the name of the petitioner has come on the basis of statement of Chaukidar. It is submitted the petitioner has no criminal antecedent.

In the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with
