02. The learned counsel for the petitioner submits that during the pendency of this petition, the petitioner, namely Ravindra Yadav has been arrested, and as such, he seeks permission to withdraw the instant petition.
03. It has been brought to my notice that the regular bail petitions of the co-accused persons were disposed of by a Co-ordinate Bench of this Court and in the light of the directions contained in Circular Order No. 1 of 2024 dated 02.02.2024 of this Court issued pursuant to the judgment dated 19th January, 2024 of the Hon'ble Supreme Court in the case of Kusha Duruka vs. the State of Odisha, Criminal Appeal No.
Patna High Court CR. MISC. No.43329 of 2024(2) dt.13-06-2024 2/2 303 of 2024, arising out of SLP (Crl.) No. 12301 of 2023, this matter becomes a tied up matter of the Co-ordinate Bench.
04. However, considering the fact that the petitioner has been arrested and withdrawal is being sought and also considering the fact that the matter has been placed before the Vacation Bench, the prayer is allowed.
05. Accordingly, the present petition stands dismissed as withdrawn.
