The petitioner seeks bail in Chhatapur P.S. Case No. 203/2018, instituted for offences under Sections 341, 323, 307, 379, 498A, 504, 506/34 of the Indian Penal Code. Later on Section 302 of the Indian Penal Code was also added.
It is alleged by the informant (since deceased) in her Farbeyan, recorded on 23.05.2018 at Surya Hospital at 8:10 A.M., that she was married with this petitioner in the year 1998. She was tortured in her Sasural by this petitioner and other family members for demand of dowry. She was ousted from her matrimonial house. Thereafter she came to her parent's house and filed case in Supaul court. She further alleged that her husband solemnized second marriage with the daughter of Satyanarayan Choudhary of village Thervit. She alleged that she again went to her matrimonial house
Patna High Court CR. MISC. No.37631 of 2019(4) dt.14-08-2019 2/2 and started living there. It is alleged that on 14.05.2018 at 11:00 A.M. while she was cooking food, petitioner along with other family members poured kerosene oil on her body and petitioner burnt her and fled away. She raised hulla then neighbours arrived and extinguished the fire. They brought her to hospital. The victim ultimately died on 30.06.2018. Thereafter post-mortem was done on 01.07.2018, wherein doctor has found burn injury on the body of deceased.
In the Fardbeyan informant (since deceased) has levelled specific allegation against this petitioner of causing her burn injury. It appears that prior to lodging of this case informant was tortured in her Sasural for that she had filed complaint case against this petitioner under Section 498A of the Indian Penal Code.
In view of such, this Court is not inclined to grant bail to petitioner. Accordingly, prayer for bail of petitioner is rejected. Petitioner is in custody since 28.01.2019.
The trial court is directed to expedite the trial and conclude the same within a period of nine months from the date of receipt/production of copy of this order.
