Petitioner is in custody in connection with Dagarwa P.S. Case No. 203 of 2017 for the offence under sections 8/20(b)IIC/25//29 of N.D.P.S. Act.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent and nothing was recovered from the possession of the petitioner. The alleged Ganja was loaded in truck and this petitioner is neither owner of the truck nor owner of the contraband. He submits that similarly circumstanced other co-accused have been granted bail by this court in Cr. Misc. No. 15777 of 2018 vide order dated 21.3.2018, Cr. Misc. 25907 of 2018 vide order dated 27.4.2018, in Cr. Misc. No. 25073 of 2018 vide order dated 25.04.2018,

Patna High Court Cr.Misc. No.22442 of 2018(3) dt.17-05-2018 2/2 Cr. Misc. No. 25211 of 2018 vide order dated 07.05.2018, in Cr. Misc. No. 20689 of 2018 vide order dated 9.5.2018 and in Cr. Misc. No. 28449 of 2018 vide order dated 9.5.2018. Considering the aforesaid, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge-cum-Special Judge, Purnea , in connection with Special Case No. 22 of 2017, arising out of Dagarwa P.S. Case No. 203 of 2017 on the condition that bailors should be family members of the petitioner.
