The petitioner seeks bail in connection with Motihari Town P.S. Case No.751 of 2016 registered under Sections 272 and 273 of the Indian Penal Code besides Sections 30(A), 36 and 37(A)(B) of the Prohibition of Excise Act, 2016. The accusation is of recovery of 15 pouches, each containing 100 ml. country made liquor, and 10 bottles, each containing 300 ml. Nepali Soufii Liquor, kept in a plastic bag, from the possession of the petitioner.
Learned counsel appearing on behalf of the petitioner submits that the petitioner having no criminal antecedent is in
Patna High Court Cr.Misc. No.7020 of 2017 (2) dt.09-03-2017 2/2 custody since 20.11.2016.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Motihari, in connection with Motihari Town P.S. Case No.751 of 2016.
