Petitioner, already in custody, seeks bail in connection with Kusheshwar Asthan PS Case No.28 of 2018, registered under Sections 22(3), 27(b) (II), 28, 28(B) and 36 of AC of the Drugs and Cosmetics Act, 1940.
Allegation in brief is that physician sample and expired medicines were recovered from possession of the petitioner and he had no drug licence.
It is submitted that the recovery was made from the house of one Triveni Sao and offences are under the Drugs and Cosmetics Act and the petitioner is in custody since 07.02.2018 and he had no antecedent of similar nature under the Drugs and
Patna High Court Cr.Misc. No.18845 of 2018(3) dt.16-05-2018 2/2 Cosmetics Act.
Having considered the aforesaid facts and circumstances, petitioner Vidyanand Yadav @ Vidyapati Sagar is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Benipur, Darbhanga in connection with Kusheshwar Asthan PS Case No.28 of 2018.
