The petitioner seeks bail in Banka P.S. Case No. 746 of 2017 registered under Section 366(A)/34 of the Indian Penal Code.

Petitioner along with his sister is said to have kidnapped the informant on the pretext of some function at Basukinath and later on administering some intoxicating substance put vermillion on her head and also extended threatening of making the video viral in case of not performing marriage of the informant with the petitioner by her mother.

It is submitted by learned counsel for the petitioner that the petitioner is quite innocent. He has committed no offence.

No.19347 of 2018 (3) dt.18-05-2018 2/2 He has been falsely implicated in the case by the informant at the instance of her uncle over some dispute of the petitioner wit her uncle two months later to the occurrence. After culmination of the function, petitioner and his sister had dropped the victim at her house on the same day. Occurrence is said to be of in the month of September, but the F.I.R. has been lodged after inordinate delay of two months without assigning any convincing and plausible reason for the aforesaid delay. The petitioner has been languishing in custody since 13.12.2017.

In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned 1st Additional Sessions Judge cum Special Judge, Banka in connection with Banka P.S. Case No. 746 of 2017 with the condition that the petitioner will not extend any sort of threatening to the informant and her family members or torment them or commit any kind of act offending the modesty of the informant else bail bond of the petitioner shall be cancelled by the learned lower court.
