JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 08-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 302 and other minor sections of the Indian Penal Code.
Informant claims that petitioner and three others took the deceased on 19.03.2014 at about 09:00 P.M. but subsequently, on the next day the dead body of the deceased was recovered. The reason behind the alleged occurrence is said to be forcible solemnization of marriage of daughter of co-accused, Upendra Yadav with deceased.
Submission on behalf of the petitioner is that coaccused, Upendra Yadav has already been granted privilege of bail
Patna High Court Cr.Misc. No.30644 of 2016 (2) dt.08-08-2016 2/2 by a co-ordinate Bench of this court and according to prosecution case itself, the deceased had solemnized his forcible marriage with daughter of co-accused, Upendra Yadav.
Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of this fact that petitioner does not have any criminal antecedent, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Barh in connection with Athmalgola P.S.
