JUSTICE SUDHIR SINGH ORAL ORDER 06-03-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offences under Sections 341, 323, 324, 307, 379 and 504/34 of the I.P.C. Later on, Section 302 of the I.P.C. was also added. The prosecution story, in brief, is that on the alleged date and time of occurrence while the informant along with his father were returning to their village after marketing, the accused persons variously armed stopped them and accused Nanhku Rishideo assaulted on the head of father of the informant by dabiya. The petitioner and co-accused Akhilesh Rishideo assaulted them by lathi and rod. Petitioner also picked out Rs.2500/- from pocket of his father and snatched his wrist watch. His injured father was admitted in P.H.C. for treatment.

Patna High Court Cr.Misc. No.6871 of 2017 (2) dt.06-03-2017 2/2 It has been submitted on behalf of the petitioner that the petitioner is in custody since 2.8.2016 and the charge sheet has been submitted in the present case. There is no allegation of tampering of witnesses alleged against the petitioner. As far as the petitioner is concerned, general and omnibus allegation has been made. The main allegation is against co-accused Nanhaku Rishideo, who is said to have assaulted on the head of the deceased by Dabiya. In the postmortem report also there is only one external injury on the head of the deceased. The other coaccused has been granted bail vide Cr.Misc.No.37350 of 2016. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhepura in connection with Murliganj P.S. case No.102 of 2016.
