The petitioner seeks regular bail in connection with Sakra P.S. Case No. 381 of 2017, registered for the offence punishable under Section 376 of the Indian Penal Code.

The allegation against the petitioner is of committing rape upon the victim girl.

The learned counsel for the petitioner submits that the victim girl has not made any statement under Section 164 Cr.P.C. and moreover, if the entire case diary is perused, no evidence whatsoever except that of the informant has transpired during the course of investigation to connect the petitioner with the alleged crime. It is further submitted that the petitioner is having a clean antecedent and he is languishing in custody since

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail. Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, IV-cum-Sub-Judge-13th, Muzaffarpur in connection with Sakra P.S. Case No. 381 of 2017.
