JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 08-04-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Sikty P.S. Case No. 07 of 2017, registered under Sections 272 and 273 of the Indian Penal Code and Section 30(a) of Excise Act. The accusation is that on receiving secret information about transportation of illicit Nepali liquor, the Police personnel reached in village Baligarh then six persons, who were carrying the bags on their head started to flee away. On chase, three persons were apprehended, including the petitioner, whereas three persons succeeded to flee away. On search, 262 bottles, each containing 300 ML, Nepali illicit liquor recovered.

Learned counsel for the petitioner submits that, in

Patna High Court Cr.Misc. No.14241 of 2017 (2) dt.08-04-2017 2/2 fact, the petitioner was apprehended by the Police mere on suspicion, while the real culprits succeeded to flee away. The petitioner has no criminal antecedent and in custody since 15.01.2017.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Araria in connection with Sikty P.S.
