Petitioner seeks bail in a case registered under Sections 392, 412 of Indian Penal Code.

It is submitted that co-accused Anand Rai, who is said to have been apprehended at the scene of the occurrence, has disclosed the name of the petitioner. The allegation is of looting Rs 1,40,000/- from the shop of the informant. The petitioner was neither arrested at the place of occurrence nor any recovery has been made from him and only on the basis of his name being implicated by the co-accused Anand Rai, he is in custody since 05.06.2017. It is also submitted that in the other cases mentioned

Patna High Court Cr.Misc. No.16743 of 2018 (3) dt.26-04-2018 2/2 in paragraph 3 of the petition, petitioner is already on bail. Considering the aforesaid submissions, the petitioner's prayer for bail is allowed. Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Gopalganj in Mirganj Police Station Case No 240 of 2015/ GR No 2628 of 2015 subject to the following conditions:

(1) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.

(2) That the petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
