JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 05-05-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with Kasma P.S. Case No. 61 of 2016 registered under Sections 341, 323, 324, 307, 504/34, later on added 302 I.P.C. of the Indian Penal Code. Accusation is that four persons named in the F.I.R. started erecting boundary covering the land of campus of temple blocking the road of the house of the informant Jitendra Bhusan. When the informant and his family member made protest, then the petitioner chased the informant with pistol and other accused persons caused injury to Kumar Sunil Dutt with khanti and Danda who became unconscious and he was rushed to Magadha Medical hospital for treatment. Patna High Court Cr.Misc. No.18642 of 2017 (2) dt.05-05-2017 2/2 Devi and Sangeeta Kumari also received injury on their persons in the occurrence.

Learned counsel for the petitioner submits that though the petitioner is named in the F.I.R., but allegation against him is only to chase the informant. The petitioner has no criminal antecedent and he is custody since 24.12.2016. Having regard to the facts and circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad in connection with Kasma P.S. Case No. 61 of 2016.
