Heard learned counsel for the petitioners and learned APP for the State.
This is a case registered under Sections 417 and 420 of the Indian Penal Code.
It is submitted by the petitioner's counsel that identical allegations have been made to many co-accused persons in respect of the same recruitment process that the L.T.I taken of physical tests by biometric machine did not match with the person who had appeared in the written test for appointment of constable. He
Patna High Court Cr.Misc. No.22439 of 2018 (3) dt.22-05-2018 claims parity with the other co-accused persons who have been allowed bail in Cr. Misc. No. 22861 of 2018 and 21119 of 2018. Prior to the instant case the petitioners have no criminal antecedent and they are in jail custody since 22.02.2018. In the facts and circumstances of the case, prayer for bail of the petitioners is allowed. Let the petitioners above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of Sub-Judge XIV-cum- A.C.J.M Patna in Gardanibagh P.S. Case No. 45 of 2018 subject to the conditions : (i) That one of the bailors will be a close relative of the Petitioners who will give an affidavit giving genealogy as to how he is related with the Petitioners. The bailor will also undertake to inform the Court if there is any change in the address of the Petitioners.
(ii) That the Petitioners will be well represented on each date and if they fail to do so on two consecutive dates, their bail will be liable to be cancelled.
