JUSTICE MOHIT KUMAR SHAH ORAL ORDER 28-06-2018 Heard the learned counsel for the petitioner and the learned APP for the State.

The petitioner seeks regular bail in connection with Rani Talab PS case no. 133 of 2017 instituted for the offences punishable under Sections 302, 201/34 of Indian Penal Code. The allegation against the petitioner is killing his own minor child.

The learned counsel for the petitioner submits that the petitioner is the father of the child and at the time of arrest by the police, he was present in his house, hence it is highly improbable that the petitioner would be killing his own minor son aged about 06 years. It is further submitted that since his wife i.e. the informant herein, was having suspicion about the petitioner

Patna High Court Cr.Misc. No.21804 of 2018 (5) dt.28-06-2018 2/2 having illicit relationship with another woman (relative), false implication by the informant cannot be ruled out. It is further submitted that the petitioner is having a clean antecedent and he is in custody since 30.07.2017.

Having regard to the facts and circumstances of the case, I deem it fit and appropriate to release the abovenamed petitioner on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Pravin Kr. Malviy, J.M. 1st class, Danapur in connection with Rani Talab PS case no. 133 of 2017. It is further directed that the petitioner shall mark his presence before the officer-in-charge of the concerned police station at 10 am on every Monday and in case of failure to do so on two consecutive occasions, the present privilege of bail shall stand cancelled automatically.
