2. The petitioner seeks bail in connection with Tariyani P.S. Case No. 210 of 2024 registered for the offence under Sections 303(2) of BNSS.
3. The petitioner is not named in the F.I.R. and is in custody since 31.04.2025.
4. As per FIR, some unknown persons stolen the motorcycle of informant from Salempur market on 12.10.2024.
5. Learned counsel appearing on behalf of the petitioner submitted that during course of investigation name of petitioner transpired on the basis of confessional

No.42050 of 2025(2) dt.21-08-2025 2/3 statement of co-accused namely Aman Kumar, in furtherance of which no incriminating material recovered/ surfaced as to connect petitioner with present occurrence of theft. It is further pointed out that said co-accused Amar Kumar has already been granted bail by one of the learned co-ordinate Bench of this Court through Cr. Misc. No. 31216 of 2025 vide order dated 20.05.2025. While concluding the argument, it is submitted that petitioner found involved in four more criminal cases where he is on bail and moreover, investigation of this case is completed, for which charge-sheet has been submitted, as such, there is no chance of tampering with the evidence.
6. Learned APP opposes the prayer of bail.

In view of aforesaid factual submission and by taking note of fact as save and except suspicion arising out of confessional statement of co-accused as mentioned aforesaid, coupled with fact that investigation of this case already completed where petitioner remains in custody since 31.04.2025, accordingly petitioner above named, is
Patna High Court CR. MISC. No.42050 of 2025(2) dt.21-08-2025 3/3 directed to be released on bail in connection with Tariyani P.S. Case No. 210 of 2024 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned I/c CJM, Sheohar /concerned court, subject to the conditions as mentioned under Section 437(3) of the Cr.P.C/ Section 480(3) of BNSS.
