Petitioners are in custody since 13.09.2016 in connection with Gandhi Maidan P.S. Case No. 310 of 2016 registered under Sections 379 and 356 of the Indian Penal Code. Learned counsel for the petitioners has submitted that the petitioners are innocent and have not committed any offence. In fact, the petitioners have not been named in the F.I.R. and merely on the basis of confessional statement before the police, these petitioners have been made accused in this case. Nothing has been recovered from the conscious possession of the petitioners nor the petitioners have been put on T.I.P. till date. The petitioners are rotting in custody for the last five months.

Patna High Court Cr.Misc. No.10817 of 2017 (3) dt.24-04-2017 Considering the nature of accusation, let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand rupees only) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.- cum- SubJudge-VI, Patna in connection with Gandhi Maidan P.S. Case No. 310 of 2016.
