JUSTICE DINESH KUMAR SINGH ORAL ORDER 11-03-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a complaint case in which process has been directed to be issued after cognizance being taken for the offences punishable under Sections 420 and 406 of the Indian Penal Code.

It is alleged that the petitioner realized rupees seventy thousand for providing employment to the complainant in Saudi Arabia but when the complainant went to Saudi Arabia, he was not provided agreement of the employment. On return the complainant demanded money which was not returned. It is submitted by learned counsel for the petitioner that

Patna High Court Cr.Misc. No.10101 of 2015 (2) dt.11-03-2015 even assuming the accusation, no offence under sections 420 and 406 IPC has been made out.

Considering the nature of accusation, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Rohtas in connection with Complaint Case No. 460 of 2009 subject to the conditions as laid down under Section 438(2) Cr.P.C.

Considering the criminal antecedent of the petitioner, the learned court below shall be at liberty to cancel the bail bonds of the petitioner in case the petitioner gets involved in serious offence or defaults without any reasonable cause on two consecutive occasions.
