The petitioner apprehends his arrest in a case registered under section 302/34 of the Indian Penal Code. There is specific allegation that the petitioner caught Mukesh Kumar and accused Bharat Rai repeatedly stabbed deceased Mukesh Kumar. Mukesh Kumar succumbed to the injuries.

It is submitted that the prosecution story is quite improbable but since there is specific allegation against the petitioner that he firstly caught Mukesh Kumar and thereafter Bharat Rai stabbed him causing his death, I am not inclined to grant anticipatory bail to the petitioner in connection with Deshari P.S. Case no. 290 of 2013 pending in the court of the Chief

Patna High Court Cr.Misc. No.49303 of 2014 (2) dt.09-04-2015 Judicial Magistrate, Vaishali at Hajipur. This application is, accordingly, rejected.
