JUSTICE SUDHIR SINGH ORAL ORDER 28-10-2016 Heard learned counsels for the petitioner, informant and learned counsel for the State.

The petitioner is languishing in custody since 11.03.2016 in connection with Birpur P.S. Case No. 119 of 2015 for the offences instituted under Sections 304(B)/34 of the IPC. The prosecution story, in brief, is that the accused persons in collusion and connivance with each other have committed murder of the informant's grand-daughter, Priyanka Kumari, for non-fulfilment of demand of dowry about which the informant has received information on 18.12.2015 that the injured grand-daughter who is wife of the petitioner is admitted in the

Patna High Court Cr.Misc. No.29549 of 2016 (4) dt.28-10-2016 2/2 hospital for burning injuries and succumbed to injury during treatment.

Earlier notice was issued to opposite party no. 2 on the submission of learned counsel for the petitioner that the matter has been settled between the parties. A petition was filed on behalf of the informant vide Annexure-2 to the present application where it was submitted that the case has been instituted due to mistake of fact. Learned counsel for the informant is also present and supports the statements made in Annexure-2 to the present application.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M.
