JUSTICE SUDHIR SINGH ORAL ORDER 07-09-2016 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is languishing in custody in connection with Alamnagar P.S. Case No. 21 of 2016 for the offences instituted under Sections 302, 201, 34 of the Indian Penal Code and Section 27 of the Arms Act.

The informant alleges that the petitioners along with other unknown persons committed murder of the deceased due to previous enmity.

It has been submitted on behalf of the petitioners that the petitioners are in custody since 23.02.2016. The charge sheet has been submitted in the present case. The petitioners have got no

Patna High Court Cr.Misc. No.30002 of 2016 (3) dt.07-09-2016 2/2 criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioners have been named in the First Information Report merely on the basis of suspicion. There is no eyewitness to the alleged occurrence nor there is any circumstantial evidence to suggest the manner in the present case. The other co-accused has been granted bail vide Cr. Misc. No. 24988 of 2016 dated 26.07.2016.

On behalf of the state it has been submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned SubDivisional Judicial Magistrate, Udakishunganj (Madhepura) in connection with Alamnagar P.S. Case No. 21 of 2016. (Sudhir Singh, J.) Amit/- U T
