JUSTICE ARUN KUMAR ORAL ORDER 09-02-2017 Heard learned counsel for the petitioners and the State. Petitioners apprehend their arrest in connection with Barauni (Refinery) P.S. Case No. 400 of 2016 registered under section 290 of the Indian Penal Code and section 30(A) of Bihar Excise Amendment Act, 2016.

Allegation is that these two petitioners were identified in head light of the vehicle but they escaped away leaving the motorcycle, a bottle of 750 ml of liquor and a mobile. It is submitted that the petitioners are not the owner of the motorcycle and also mobile phone is not theirs. It is further submitted that the petitioner no. 1 has only one police case of similar nature but he is on bail.

No.5395 of 2017 (3) dt.09-02-2017 So having considered the said facts and circumstances, in the event of arrest/surrender within four weeks from the date of receipt of this order to the court concerned, let the petitioners, namely, Arun Pathak and Awdhesh Singh @ Abdhesh Singh be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Barauni (Refinery) P.S. Case No. 400 of 2016, subject to the conditions as laid down under section 438(2) of the Cr.P.C.
