JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 16-02-2016 By way of the present application preferred under Section 482 of the Code of Criminal Procedure, 1973, the petitioners seek quashing of the first information report of Bhaptiyahi P. S. Case No. 71 of 2014 registered under Sections 323, 504 and 506 of the Indian Penal Code and 3(1)(x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989.

At the outset, it has been pointed out by the learned counsel for the petitioners that during the pendency of the

Patna High Court Cr.Misc. No.33609 of 2015 (3) dt.16-02-2016 2/2 application, after completing investigation the police have already submitted their report under Section 173(2) of the Code of Criminal Procedure before the Court of Magistrate. In that view of the matter, the present application is disposed of as infructuous with a liberty to the petitioners to file an appropriate application in accordance with law in case, an adverse order is passed by the Magistrate against them after perusal of the police report.
