JUSTICE DINESH KUMAR SINGH ORAL ORDER 08-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 7 of the Essential Commodities Act.

It is alleged against the petitioner that petitioner being a PDS dealer supplied 11,672 quintal wheat and 175.08 quintal rice but during inspection only 102 quintals wheat and 147 quintals rice were found.

It is submitted by learned counsel for the petitioner that the inspection was made after one and half month of delivery of the food-grains and the shortage is meager quantity. It is further submitted that licence of the PDS shop has already cancelled. Considering the quantity of shortage and petitioner
