The petitioner is in custody in connection with Complaint Case No. 1627 of 2016 filed for the offences punishable under Sections 406, 420 of the Indian Penal Code. Learned counsel for the petitioner submits that petitioner was the Honorary Director of the company, registered office whereof was at Kolkata. He submits that the petitioner is also one of the victim as he has invested to the tune of Rs. 11 lacs and odd. Since he has allowed his house to be used as office of the company and investors have invested in the hope that they will be getting monthly 1800/- as interest on deposit of Rs.

Patna High Court Cr.Misc. No.23205 of 2018(3) dt.18-05-2018 2/2 1 lac.

Learned counsel appearing on behalf of the complainant submits that investors have invested in the company only because this petitioner was the Director and local person and the investors have been duped.

Considering the totality of the fact including the fact that the petitioner has remained in custody for nearly six months, the Court is inclined to grant bail to the petitioner above named on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Sri Kumar Pankaj, Judicial Magistrate 1st Class, Bhagalpur in connection with Complaint Case No. 1627 of 2016, subject to the condition that the petitioner will not dispose of the house used as office and the other properties purchased in the name of the company.

Bailors shall be the family members.
