2. The present application has been filed for anticipatory bail in Dumariyaghat P.S. Case No. 50/2018, but from the records, it appears that final form was submitted finding the case to be false and thereafter protest petition was treated as complaint petition and inquiry witnesses were examined and cognizance has been taken and petitioner should have moved for anticipatory bail in that case, but instead of moving for anticipatory bail in the complaint case, the petitioner has moved for anticipatory bail in Dumariyaghat P.S. Case No. 50/2018 in which he is not an accused and therefore the entire

Patna High Court CR. MISC. No.41398 of 2026(2) dt.08-07-2026 2/2 exercise of moving for anticipatory bail in Dumariyaghat P.S. Case No. 50/2018, its rejection by the court below is useless as the petitioner has no apprehension of arrest in Dumariyaghat P.S. Case No. 50/2018.

3. Considering the above, this application stands dismissed with liberty to the petitioner to file afresh anticipatory bail application in the court below in Complaint Case No. 1626/2019.

4. Learned counsel for the petitioner has annexed the order dated 27.02.2026 passed in Cr.Misc. No. 88724/2025 arising out of Dumariyaghat P.S. Case No. 50/2018.

5. List Cr. Misc. No. 88724/2025 after one week under the heading 'For Orders' along with the records of this case.
