JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 05-03-2021 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. This application for grant of regular bail arises out of Excise Case No. 977 of 2019, registered for the offence punishable under Sections 30(a), 38, 32, 41(i) of the Bihar Prohibition and Excise Act, 2018.

The Excise officials are said to have recovered 964.080 liters of illicit Indian Made Foreign Liquor from a Mahindra Pick-up Van. The occupants of the said vehicle allegedly managed to flee away. The petitioner was named in the First Information Report as one of the two who had managed to flee away.

Learned counsel appearing on behalf of the

Patna High Court CR. MISC. No.36974 of 2020(5) dt.05-03-2021 2/2 petitioner has drawn my attention to an order of this Court dated 21.12.2020 passed in Cr. Misc. No. 34522 of 2020, whereby similarly circumstanced co-accused Ravi Kumar has been allowed regular bail. The petitioner is in custody since 28.08.2020.

Considering the circumstance that similarly situated co-accused has been allowed regular bail by this Court, this application is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge Excise, East Champaran at Motihari, in Excise Case No. 977 of 2019.
