Petitioner, already in custody, seeks bail in connection with Maker P.S. Case No.151 of 2016, registered under Section 30 of the Bihar Excise Act.

Allegation in brief is that the petitioner was preparing illicit country made liquor and 30 litres of Mahua liquor was recovered along with some utensils, like, bucket and other items.

Learned counsel appearing on behalf of the petitioner submits that nothing was recovered from possession of the petitioner. The seizure list shows that it was no-mens land as it was recovered from the Diyara area and the petitioner was also not apprehended at the spot.

Patna High Court Cr.Misc. No.11438 of 2017 (2) dt.15-03-2017 2 / 2 However, the petitioner has been in custody in this case since 21.01.2017 and except a case under Section 323 and other allied sections of IPC, he has no any other criminal antecedent.

Having considered the said facts and circumstances, petitioner Gobardhan Sahni is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Chapra (Saran) in connection with Maker P.S. Case No.151 of 2016.
