JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 28-04-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with Sugauli P.S. Case No. 289 of 2016, registered under Sections 363, 366(A)/34 of the Indian Penal Code.

The accusation is of kidnapping of daughter of the informant by the petitioner and his other family members on 20.11.2016 for the purpose of marriage. It is alleged that a Panchayati was arranged by the informant in which petitioner assured to return his daughter, but his daughter did not return to his house, then informant lodged this case on 14.12.2016. Learned counsel for the petitioner submits that, in fact, the petitioner is next door neighbour of the informant.

No.17576 of 2017 (2) dt.28-04-2017 2/2 Further submission is that daughter of the informant, who is major moved from the house without giving information to her family members, thereafter, mere on suspicion, the informant lodged the present case after 24 days of the occurrence raising suspicion against the petitioner and his other family members having hand in the kidnapping of his daughter. The petitioner is in custody since 19.12.2016 and after investigation Chargesheet has also been submitted.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Motihari East Champaran in connection with Sugauli P.S. Case No. 289 of 2016.
