Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in connection with Chainpur P.S. Case No. 71 of 2021, registered for offence punishable under sections 341, 323, 379, 504, 506/34 of the Indian Penal Code and later on Sections 395, 411 and 412 of the Indian Penal Code was added.

As per allegation, the petitioner has stolen away some sheeps of the informant.

The learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.40054 of 2022(3) dt.11-01-2023 2/2 that the petitioner is not named in the FIR. His name figured on the basis of confessional statement of co-accused Birbal Mushar and he is a person of clean antecedent.

On the other hand, the learned Additional Public Prosecutor has opposed the prayer for bail.

Considering the above-mentioned facts and circumstances, the petitioner above-named, in the event of his arrest or surrender, within four weeks from today, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-II, Kaimur at Bhabua in connection with Chainpur P.S. Case No. 71 of 2021, subject to condition as laid down under section 438(2) Cr. P.C. Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
